For the past few months, there have been no green cards available for persons in the employment-based third preference category (EB-3) and long backlogs in the EB-2 category for persons born in India and China. So, with few green cards to grant, why has the USCIS been scheduling interviews for persons in these categories? The short answer is that just because the USCIS cannot grant most EB-3 and EB-2 applicants green cards, the agency can take advantage of the lull in applications for adjustment of status to deny persons with pending applications. Hi,
I've been working full-time on EAD for the last 2+ years. I have a pending 485 application, on which my spouse is the primary applicant. I have never applied for H1B in the past, because I transferred directly from F1 (student visa) to this EAD.
My spouse also has an H1B, which is in it's 7th year (completed 6 yrs of H1B).
My spouse has been put on furlough (unpaid leave) for 3 months.
What are our options ?
1. Can my employer file H1B for me, and an H4 for my spouse ? How will this affect our green card application (on which my spouse is primary applicant) ?
2. How much time does my spouse have to look for another job (with similar job description), without being out of status ? Is there some grace period associated with H1?

I am on 8th H1b extension with approved I140 and 3yr extension. Now I want to join a new company, who does my H1B and will get 3yr extension on that. If my parent employer revokes my I140, will my new H1B (with new employer) gets void ? or is it still valid for me to work with new employer for next 3 years. I dont want to apply for LC and I140 with the new employer as I will be R2I in August 2007.

Hi Guys,
My I-140 was processed at the Nebraska center, but my attorney sent the I-485 case to Texas Service center. Since my I-140 was filed at Nebraska, I was expecting my I-485 would be sent Nebraska also.
Should it be sent to Texas center or Nebraska?

My wife has her h4 visa stamping in a week's time. I have sent her all the documents required.
My question is, it is mandatory for her to carry my original I-797 petition and I-129?? I have sent photo copies of both the documents, but I read some where that she has to carry originals of these 2 docs. can you pls clarify??
