    My I 485 package was returned as it didnt have the approval notice of I 140, which was submitted a day later than I485 by my company.
    It is such a frustrating situation as i have been waiting since 1999 for my GC , and when i got this golden chance my company was not serious enuf to submit the papers in time !
    I am doubting the company , as they would have done all this intentionally to keep me in their co. for longer time!The returned letter they have provided me shows no reference no, file no, or either my name ! how can i believe if they have even submitted any papers for I485 or not ?
    They say they can refile again .. but duno what to do ??
    Can anybody be kind enough to help me out here!
    I am so frustrated that I feel like going back to home country now.

    Hi Guru's,

    I am currently in INDIA and applying for my H1. I have a couple of questions regarding this:
    Back Ground:

    1. My husband and myself are applying for H1 B.
    2. Company A is sponsoring H1 for my husband and company B is applying for H1 for me.

    Q & A:

    1. As H1 B is lottery system this time too, we both are applying for H1. Is it possible that, if both of us get H1's, can I still enter into US on H4 status and later convert to H1.

    Your valuable suggestions are greatly appreciated.

    Is it possible? Pro-active Finger-Printing without appointment letter.

    I have done my FP on March 1st 2005, since the validity is now expired, i called the VSC to enquire when and if i will be getting another FP notice soon.She told me that i can contact the local ASC(Application service centre) and go for the Finger-printing without any formal Notice/Appointment Letter.

    Has anybody done this? ie has anybody done Pro-active finger-printing without appointment letter? Please reply.

    Hi friends

    I am not sure if I am posting it in the right forum. So please excuse me if not. My cousin have some immigration case going on in San antonia, Texas court. She lives in California. DOL is republishing and reinstating regulations in place on January 16, 2009, for 9 months, after which the Department will either have engaged in further rulemaking or lift the suspension.

    Please let me know if 140 processing times is based on receipt date or notice date?

    I'm a concurrent 140-485 filer, filed on July 2 2007. My notice date on I-140 says August 16, 2007, where as my friend who filed only140 on july 2 has Notice date of july 12. Does that mean his will be processed first?

    I have been on q job with a client since October. The setup is like this. Me->my employer->Vendor-.Client.

    The work order my employer has states that my work with the client ends June end, with a possibility of extension. if i file my h1b now, will i be a good candidate for rejection , considering that I do not have a long term project? Also, how true is it that the USCIS is giving visas out only for 1 year under such circumstances, as opposed to the regular 3 years term, and if true, how do I avoid it

    Lastly, what is your take on how H1 filings on Apr 1 2010 will be? Is it expected to the same as last year, or will companies file left right and center on day 1 itself?

    My approved PERM and I140 (in process) were applied using the old cancelled pp.

    I got a new passport last week.

    Is there anything I need to do since i have the new PP now?

    Call them and tell your status and ask him/her your specific questions.
    They will give the correct and upto date information. They are very helpful and fully knowledgable of the tax law. You can even get the ID number of the person whom you spoke with for your reference.
