Hello,
I am in a pretty scary scenario...
My I-140 got denied based on inability to pay. My firm did send out the appeal to fight out the case. The appeal was sent 15 days back with the time limit stated in the denial letter. But today, I received the I-485 denial for both me (primary applicant) & my spouse (dependent).
I have H-1 as a back up but my spouse does not have H-4 status.
My Questions & concerned:
1) How long does it take INS to accept the appeal as I haven't seen any update on the same since the package has been delivered (15 days)?
2) What is next possible step for my spouse & how long can he stay in this country without applying for H-4?
3) If the appeal is accepted & the case gets into processing, will I-485 get back on track for processing & can my spouse start working on EAD?
Would appreciate any sought of guidance possible from the expert lawyers & the individuals with the similar experience & knowledge.
Time is very crucial & so immediate reply will be highly appreciated...

Can someone give me any suggestions?
I have filed for my AOS, last week.. I am assuming that i will get my EAD, AP in next 3-4 months......
a.) Once we get our EAD's can we go to India for a period of 6 months...even without receiving our physical GC? and yet return to US??
b.) After filing for AOS, can we leave US for a long period (6 months)..so in that case will we still get our EAD/AP/GC's???????
any answers?

I came to US on L1 in 2005 thru COMPANY-A and then applied for H1B thru COMPANY-B in 2006 and got approval under 2007 CAP. But I didn't start working for COMPANY-B(H1B) and went to India after H1B approval but came to US on L1B again to continue my work with COMPANY-A(Did a leapfrog).
In 2009 I transferred my H1B from COMPANY-B to COMPANY-C and got the petition approval. So I have a valid H1B petition with COMPANY-C.
In the same year my COMPANY-A(L1B holder) applied for COS to H1B under new 2010 CAP and got approval. So my status has been changed from L1 to H1B with COMPANY-A.
Now I have 2 approved valid petitions, one with COMPANY-A and the other with COMPANY-C, my question is if I get an offer from COMPANY-C can I start working with them with out any H1 transfer application ?
or can I transfer my H1B from COMPANY-C to another COMPANY-D ?

Hi,
Find below my current visa status
1. H1B 6 years completing in Jul 2009. My firm will apply for extension in March time frame
2. I have applied for I-485 and have EAD + AP.
I am planning to travel to India for a week on AP sometime in May. I have the following Qs on this
1. Can I travel to India with AP when H1B extn is pending.

Can I work with different employer without my sponsor company knowing about it? I have a EAD and I can change jobs(180 days is over). Now planning to start a company/to work on W2 with new company. I want to use the medical benefits from sponsor company(withought quitting the job).

Hi,
I tried to search for this and could not find anything.
When dealing with 485 portability using EAD (with approved I140),
what happens if your underlying LC is a location/region/state bound and you end up moving to out of that specified region.
Job duties/job code can stay similar with probably salary increase.
Does the location violation get equated to unequal/dissimilar job duties resulting in 485 denial?
Chances are that should I have to invoke AC21 portability(due to layoff or something alike), I'll be facing this so I just want to be prepared for possibilities.

Here's one question I have which I haven't see in any forums so far (perhaps its lurking somewhere .. who knows) ... let me get to the point.
When filing for AOS/485, if the I-140 that was filed prior to filing AOS was pending and gets approved AFTER 485 was filed... should we explicitly inform USCIS that that 140 was appoved ?
I guess USCIS should have that information (of course!) but I am not sure if we should be pro-active and make sure we inform the service center that the 140 was approved ?!
