Dear all:
May I ask what I should do in the following situation?
I hold F1 visa and my new job starts on Sept 1. The int'l student office of my current university mistakenly set my OPT start date on May 6. My OPT has been approved and EAD card arrived.
That is, I will have 120-plus "unemployment" days accumulated by early August, which will then violate the "90-day unemployment rule" of OPT.
I am under tremendous pressure and really want to hear your opinions.

Ajay K Arora from H1B1.com was a good lawyer for me. I was in KY at the time and had the luxury of choosing my own immigration lawyer. I did H1 + renewal, and RIR labor that got recently approved, but I am with a different company now, so can't use labor cert, and I have to put up with the company's law firm whose service is of course, awful.
He is located in NYC. The reason I chose him is someone else recommended him for me.

how can we monitor the process (the processing dates then become irrelevant)...

I am currently on H-1b and my wife is on H-4. My current job will be terminated on 8/15 and my wife has received H1b approval notice to start full time on 10/1. We have a US born baby who requires future post-surgery follow-ups. I was on F-1 visa, requested OPT through the university, but I didn't applied to USCIS, because I got H-1b premium processing approval. My wife has a valid H-4, and unexpired B1/B2 visa. So my questions are:
a) Between 8/15 and 10/1, are we out of status?
b) I should file a change of status. Should I file
(b-1) H-1b to H-4 directly (effective 10/1)?
(b-2) H-1b to B1/B2 (before 8/15), then B1/B2 to H-4 (effective 10/1)?
(b-3) H-1b to F-1 (before 8/15), then F-1 to H-4 (effective 10/1)?
(b-4) F-1 OPT with university endorsement, if they are willing to do it?
c) Do I need to go abroad and actually get B1/B2 visa since I never got one? I think a change of status should be okay.
Any suggestions are welcome. Thanks.

Iam an H4 transferred to H1B. I am on H1B since one year. My pay is less than the one mentioned in LCA, but more than the prevailing wages. My job profile also includes some part of salary as comission, which I would get at the end of the year. This is apart from the salary Iam receiving right now (greater than the prevailing wage and less than LCA). Do I face any problem if I happen to go for H1B visa stamp. Could you also suggest me how to defend myself if I am asked the difference in the salary by visa officer. Thanking you all in advance.

Few queries
1) Can my employer keep my H1B open and show that the job is available for me? If so, for how long can employer do that?
I may go for six months, year or more, depending on circumstances.
2) If after a year a new H1B is filled, by the same employer (given that old H1B cannot be opened for long) will I be able to utilize the old quota or would have to file in new quota.
3) If I come back after a year, does the 6 year counter restarted? ie. the limit of working for six years on H1B.
4) If my employer cancels my H1B, and after six-months or a year, a different company files a petition for H1B, will the petition fall in old quota? Or will have to wait to be filed in new quota for that financial year?
If someone could answer my queries and help me decide, it will be very helpful.

Folks,
I just realized that I forgot to add a piece of my employment history to the DS-160. I only realized it once I set up the appointment for H1-B stamping through VFS. I have all the corroborating paperwork (W2, paystub etc.) for that period. Do I need to re-do the DS-160? I already have an appointment and if I cancel the appointment and re-do the DS160 I might run the risk of not getting the date of my choosing. The problem is my existing company is a "successor in interest" of the company I forgot to mention. That is, I got my I-797 from this previous company.
Please not that the facts in the existing DS 160 are true. It is just that I realized that there is a gap that I might have to fill.

I was keep observing the PERM approval rate trend for the past one year. Approval rate is very slow. But it is suddently jumped since last month. Looks like it is a good time to start filing another labor. I am in the same boat. Trying for a new employer for EB2.

Hi,
I had a question regarding the july bulletin where it was mentioned that Old fees is entertained for employment based petetions while family based it would be new fees for I485.
Mine was applied by my company on July 2nd with old fees and Spouse's was applied on August 3rd with old fee and was rejected! I-140 was approved on August 8th and applied in March 2007!
Did they confuse with family based and rejected for fees?
Spouse should also be employment based right!
Can somebody answer my question or suggest any other possibilities for rejection?

I spoke with TSC Rep today. I called up to re-check what lot of other guys are saying here that TSC no longer is honoring 180 day namecheck rule mandated by court few months back.
TSC Rep said she has no idea about 180 day rule but knows about FBI/USCIS joint effort for clearing name checks pending more than year, 2 years etc.
So atleast, my call suggested that some people at USCIS have no idea about 180 days rule mandaged by court.
