My H1b got Approved and starts from OCT 1st and OPT Extension Expires in July 1st week.
I am travelling to India for 2 weeks in next month.

Do I need to go for Stamping? or my Current student status is valid :confused:

If your wife is using the EAD obtained after you filed I-485, she is no longer on H4. Technically there is no reason for her to still be on H4 but if you want her to maintain H4 she may need to travel out of country and obtain a new H4 visa with your new approved H1.
Also technically she was not out of status since you spplied I-485 before the previous H4 expired.

I sent the applications(I-140,I-485,I-131,I-765)to Nebraska center 3 weeks ago and it was received by them on December 17,2007(because I tracked the FedEx package).Until today,no receipts yet and my checks are not cashed yet and the receipting update says Current for Nebraska, is the normal or there is something wrong?

Hello Members,

I noticed that the dates on my i-765, i-131 and i-485 changed to 9/1/2008 today. This has not changed since I got my EAD. None of my wife's dates have changed. Does this mean anything? The things I have done lately that might (or might not) have caused this:
- Called CSR to check on status. She asked me to call back as my processing dates are not current yet.
- my lawyer sent G-28 so they could check on any information for me.
Here is some info:
i-140: 9/26/2005
i-485: 7/23/2007
EB-2

Any ideas?

Hi,

My husband is on H1-B, and it expires on Feb 4th 2007. We plan to go to India, leaving the U.S. on Feb 11th 2007. His current I-94 expires on Feb 4th 2007.

We have our I-140 and 485 filed in parallel. He has received his EAD and Advanced Parole.

His lawyer wants to apply for H1-B but not use premium processing, as he can re-enter the U.S. using Advanced Parole.

Now, our concerns are these:

1. If he leaves the U.S. AFTER the expiration of his current I-94 WITHOUT having a new I-797, can it look as if he overstayed?

2. If he re-enters the U.S. using the Advanced Parole, will that change his status so that he is now considered to be on immigrant(EAD) rather than non-immigrant (H1-B) status?

Basically, we want to insist on premium processing and go for the H1-B visa stamp while in India to be sure that he does not go out of status.

Any advice on this?

i know that if i work for 1+ yr with employer B outside USA then i can come back to USA on L1-A visa.

my question is - during this 1 yr period, can i work for employer B in USA on H-1B?

Should I be concerned? What if the postal service missed/lost it?

Hi All,

This is my scenario.

1) I have an approved I-140 from my future employer company and the priority date is may-2003 (EB3).

11) I have filed my 485 and 140 concurrently in august EB2 category from my current employer. The priority date of my labor is nov-2006.

Please provide me your guidance can i use my approved 140 PD (may-2003) in my filled 485.
