Hi,
I would like to have an expert advice on the matter below:
I am working on AC21 under a company that is going to be bought over completely by another company at the end of March next year. The corporate attorney mentioned that effective 04/01/2010, my company will stop existing as a separate entity and all AC21 guys will need to re-file their AC21 with USCIS (of course, submitting AC21 is optional).
We are planning to visit India for a month or so (my wife might stay there for longer) in the beginning of March next year. We have a valid Advance Parole until 08/31/2010 to re-enter USA. We obtained this Advance Parole when I was still working with the employer who sponsored my I-140.
Some questions
-- Is it safe for us to come back to USA after March 2010?
-Or shall I first file AC21 with the new company and then, leave USA?
I am the primary applicant of our 485 application and my wife's 485 is dependent upon me.
Please let us know so we can plan our trip accordingly.

I know this one guy has done this he worked on h1 for 6 years after that he didnt get extension so he changed his status to f1 as full time student ...now he is on f1 visa...so dont worry.

However, no one was prepared for today's announcement from the State Department that most of the family-based categories will retrogress between one and three years beginning on January 1, 2011. I've just received an RFE for my I-485. I am feeling incredibly disheartened because I thought I'd done everything right and I am struggling not being able to work or travel... I have a seriously ill family member back home, and my husband and I have an understanding that if anything happens I'm getting on the plane no matter what. I'm just praying I get my AP soon so the "no matter what" doesn't have to mean abandoning our home and life here in the US.

2 (a) is only if you have an approved I-140. In your case write "Concurrent filing of I-140/I-485 based on NIW"

Hi all,
My ETA case in online status shows "DATA REVIEW" for the past 5 months, my PD Aug 04/RIR/EB2 is with Dallas BPEC.Initially the status was closed, and then opened. After 5 months of reopening it still says 'Data review' .Is there some thing wrong or should I talk to my lawyer.
Some of my friends who applied that time have their status 'in process' or even 'certified' .Any experience like this or will that go to certified from here directly or to "in process" first. How long it can be in each of these statuses.
Any ideas appreciated please!

I work for a big 4 consulting firm and transferring my H1-B to a client (a 2 Billion dollar american company).......I'm planning to join my new company only after the visa has been transferred ........my questions are:
1.) If the transfer is rejected, can I work for my current employer (assuming I dont resign)
2.) My wife's on H4 and recently applied for COS from H4 to F1 - Do I need to file for her H4 transfer also or not?
Not sure what's the effect of H1 transfer on wife's pending H4 to F1 application.
Need help ASAP. Thanks a lot.

My company has applied for my 8th year extension (3 years) based on my LC and I-140 that was applied in CA. (My LC and I-140 have been approved). But during my 7th year, I moved to NC state with the same company/department. The LCA for the extension includes both CA nad NC work locations and NC residence address.
Will there be a problem with extending the H1 using the I-140 that has been approved for CA? Will USCIS question why I am in NC when the I-140 shows a CA Address?
Please let me know your opinion.
