Hello All,
I am currently working for Employer A for the past 6 years and my current H1 is Expiring in May End 2010. MY employer says he will file the H1 in may starting. In the meantime I got an offer from a future employer B who applied for my H1 transfer in premium processing. We got an RFE and the new employer is working on that .
My question is that lets say After responding to RFE by my future employer B , god forbid say the H1 transfer is denied. Would this denial have any impact on the H1 Extension that my current employer A plans to file in couple of weeks using I-140 approved petition. Please advice ?
Thanks,

Hello Friends
My husband was an employee of a desi company and they had withheld part of his salary, he filed a complaint at the DOL and got the pending money back.. that was 4 years back.. now he is trying to change his job and the new employer wants to do his background check..
what will show up in his background check? will the case against his employer affect him? we are really worried about this.
Thanks in advance

Wingnut Alan Keyes says repealing the 14th Amendment is going too far. And lest wingnut readers of this blog (you know who you are) wave public opinion polls that seem to support this, I would remind you that the whole point of enshrining civil rights protections in the Constitution is precisely to protect minorities from the tyranny of the majority. If you would have put segregation up for a vote in my part of the world back in the 1950s, you would have found overwhelming support. The judge who tossed out the Proposition 8 referendum on same sex marriages in...

I would really appreciate it, if someone could give me some advice.
Here is my situation, in January 2005, I married my girlfriend, who I had dated for little over a year. She is a US born citizen, so we decided to file for my permanent residency upon marriage. Upon receipt of my Green Card in Jan 2008, I filed for naturalization. Our relationship started heading south last year. We tried counseling and it didn't work out. We finally decided to part our ways amicably in Sep, 2009.
I am 34 years old and for reasons unknown to me, I am showing signs of age. I have been also getting some pressure from my family in India to remarry. Though I do not have any plans to marry immediately, I wasn't sure if my getting naturalized in February 2009 would have any impact on marrying someone from India sometime next year?
Please let me know, if there are any cooling off period required?
Thank you.

A new study by the Transactional Records Access Center (TRAC) finds that the nation's Immigration Courts are becoming increasingly backlogged. Our country's 234 immigration judges received over 350,000 new cases last year, almost 1,500 cases per judge. Coupled with the government's onerous "case complete goals", this brings incredible pressure on overworked immigration judges to issue decisions. As a result of the increasing backlog of cases, persons in detention may have to wait many months to challenge the legality of the charges against them or to have their asylum and other claims heard before a judge. The Bush Administration had promised...

Hello everyone,
I had come and been living in California since Feb 2010 under F1 visa.
My mom filed the form I-130 to petition me last year when my PD was current (Dec 2010), I filed the form I-485 to AOS. I got fingerprint done and was issued the EAD card plus a valid SSN and Alien number also. And last week I just got the INterview done at the local USCIS. Unfortunately, the officer said because the retrogression of visa bulletin, my PD wasnt current anymore, and all the paperwork was sent to NBC to be saved there and when my PD comes, they will issue me my GC.
I am currently going to school, and Im wondering if Im qualified for FAFSA, and am I considered as CA resident so that I dont hav to pay out-of-state resident?
Also, I will be filling out my transfer application to a university this FALL (Im going to a Community College now), what should I write for my immigration status and etc?
I will rly appreciate ur feedback!

I filed for my wife's 485 on July 2nd. Assuming USCIS accepts/issues a receipt, how does USCIS decide which case to pick up first, would it be based on RD OR would the case get priority over other cases since the primary applicant has been approved? Any memos, opinions around this?

Welcome news from the US Travel Association: H.R. 2410, the "Foreign Relations Authorization Act, FY 2010-2011", includes a provision that authorizes the Secretary of State to conduct a two-year pilot program to use secure, remote videoconferencing technology to conduct tourist visa interviews. The travel industry introduced this idea to the government in its 2007 Blueprint to Discover America. "America's travel community is grateful to House Foreign Affairs Committee Chairman Howard Berman and Ranking Member Ileana Ros-Lehtinen for their leadership on this critical reform to America's visitor entry process," said Roger Dow, president and CEO of the U.S. Travel Association. "The...

Hello Attorneys,
My company recently moved offices to a new location just a few miles from the old location. Its in an adjacent county but with in the same state. We moved from Northbrook, IL to Deerfield IL, does this warrant a change in LCA/H1B?
Please advise.
Thanks
Most attorneys have historically advised to file ammendment to LCA in case of address change like this. Provided that job conditions same, (which is likely in your case as it is just a few miles away) ammendment should be easy.
Good Luck.

ICE officials have announced the break up of a major marriage fraud ring in Texas. According to ICE: A 72-year-old grandmother who operated a marriage fraud ring for decades was sentenced Sept. 23 to serve 44 months in federal prison. Two of my favorite things about America joined up! From the Grand Canyon to Yosemite to Hawaii Volcanoes National Park to Great Smoky Mountains National Park in my part of the world, the United States has one of the world's great national park collections with spectacular beauty and millions of square miles protected from development. And obviously our longstanding commitment to maintaining a vibrant, open immigration policy (despite the best efforts of xenophones to destroy it) has made us an example to the world. From the National Park Service: The National Park Service is partnering with U.S. Citizenship and Immigration...

Hi
I am on H1B visa and married to a mexican citizen for past 2 years. we both have been living in mexico for past 2 years ( i am working as an Expat). 4 years ago my wife was in US on a Tourist visa and attended community school to learn English. she left the country in 6 months but while re-entering she mentioned her going to school to the agent upon which they processed a expedited removal and put a 5 year ban. She will complete her 5 years in Feb 2012. We are going to have a baby soon and would like to move to US next year after her 5 years are complete. i want to apply for a H4 visa for my wife and my baby. Will her expedited removal cause a problem with H4 application? thanks in advance.

My employer was planning on sponsoring me, and paying all the filing fees, but the deal was that I was going to pay the lawyer directly for the legal fees. I just found out from a second lawyer that technically we can't do that because it will drop my salary below the prevailing wage. Is there anything I can do to get around this, and still pay the legal fees? Is it completely against the law for me to pay them or is that just an "interpretation of the law"? The other possibility is my husband could pay the fees, but I don't know if that's allowed either.
Let me know if you have any advice - we have to have everything signed by this Friday.

I saw an update in my case status on July 10th.
It says, RFE received and case reprocessing started..what does this mean?
anybody else has seen this?
Did you get any RFE and responded back to USCIS?. Then your status will change like this.
